Why the Dow may not make it to 14,000

Traders are chattering about some troubling signs ? most notably a breakdown in small caps ? as reasons why the?Dow Jones Industrial Average?may not make it to 14,000 anytime soon.

The Dow began Wednesday just 46 points from topping the milestone, on a clear course this week to trade above a level it hasn't been near since 2007. But something funny happened along the way.

Stocks with smaller market values ? as represented by the?Russell 2000?(IWM) ? got pounded. Smaller companies are considered to be more risky than their larger brethren and are therefore considered to be a leading indicator of the animal spirits that lead a rally.

"The Russell led us up and will lead us down," said Doug Kass of Seabreeze Partners Management.

History shows Kass is right ? at least about the first part. The Dow is up about 10 percent from its fourth-quarter low caused by fiscal cliff jitters. The Russell 2000 is up a more explosive 15 percent over that same time period.

"The small caps were a great tell, as well as the transports," said Phil Pearlman, trader and executive editor of StockTwits.com. "We're overdue for a pullback."

The Dow Transportation ETF (IYT) was hit even harder on Wednesday. Traders typically look for confirmation from the Dow Transports that a breakout is for real because it's made up of companies linked directly to economic growth, such as?UPS?and?Union Pacific.

"Small caps broke, transports broke," tweeted trader J.C. Parets today. "All signs pointing to midcaps next followed by S&P's."

Parets, president of Eagle Bay Capital, was among the first and most vocal to point out these red flags on the social network.

Another key indicator bearish traders point to is the?Citigroup?Economic Surprise Index, which turned negative this week. The index from the bank measures how key economic data performs relative to consensus estimates from economists.

Fourth-quarter gross domestic product unexpectedly dropped at a 0.1 percent annual rate, according to the Commerce Department today. Economists were expecting an expansion of at least 1 percent.

To be sure, not everyone sees these indicators as signs of trouble, but rather a signal this bull market is maturing.

"If we continue to get bonds into stocks, those investors are likely looking for large cap dividend-payers, not as much small caps," said Stephanie Link, director of research at TheStreet.com.

Facebook's mobile ad revenue doubles in fourth quarter

SAN FRANCISCO (Reuters) - Facebook Inc doubled its mobile advertising from the previous quarter as the world's No. 1 social network expanded its business aggressively onto handheld devices.

But the growth trailed some of Wall Street's most aggressive estimates. Extending its reach on mobile devices is crucial as more and more of its 1 billion-plus users begin to access its network via smartphones and tablets.

The company's overall advertising business grew at its fastest clip since before its May initial public offering, helping the company's revenue expand 40 percent and surpass Wall Street targets.

Shares of Facebook were flat at $31.24 in after hours trading on Wednesday, regaining ground after falling more than 8 percent immediately after the numbers were released.

"Overall solid quarter but maybe high expectations going into the quarter," said Aaron Kessler, an analyst with Raymond James.

Facebook said its mobile business accounted for 23 percent of total ad revenue, compared to 14 percent in the third quarter.

Some investors may have been expecting more from the mobile business.

"Mobile revenue was expected to be a little higher," said Kessler, who said he was looking for mobile revenue to be 25 percent of total ad revenue.

Finance Chief David Ebersman said that Facebook had "basically doubled" mobile ad revenue from the third quarter to the fourth quarter.

"Two quarters ago we really had no mobile revenue," Ebersman told Reuters in an interview. "In the course of a pretty short period of time, we've dramatically ramped up our ability to monetize mobile."

The total number of monthly active users on the social network reached 1.06 billion at the end of last year, with 618 million daily active users, Facebook said.

Facebook shares, which lost more than half their value following its May initial public offering, have regained ground in recent months as concerns about its mobile ad business and insider selling have eased. Shares have surged roughly 60 percent since mid-November.

Facebook said net income in the fourth quarter was $64 million, or 3 cents a share, compared to $302 million, or 14 cents a share in the year-ago period.

Excluding certain items, Facebook said it earned 17 cents a share, compared to the 15 cents a share expected by analysts polled by Thomson Reuters I/B/E/S.

Facebook has ramped up its online advertising services in recent months, putting a greater emphasis on mobile ads and introducing capabilities that let marketers target Facebook users based on their Web browsing history.

Advertising revenue in the fourth quarter grew 41 percent to $1.33 billion, with mobile ads representing 23 percent of Facebook's ad revenue.

Facebook's overall fourth-quarter revenue was $1.585 billion, versus $1.131 billion in the year-ago period. Analysts were looking for revenue of $1.53 billion.

George Zimmerman is running out of money to pay for his legal defense, his lawyers say on a website set up to solicit donations.

Zimmerman, a former neighborhood watch volunteer, is charged with second-degree murder in the shooting death of Trayvon Martin, an unarmed black teenager, on Feb. 26, 2012, in Sanford, Fla. He has pleaded not guilty.

On Wednesday, Mark O?Mara?s firm, which runs the website?GZDefenseFund.com, tweeted that there was an update to the site. In the update, the lawyers say they are preparing for a hearing on Zimmerman?s self-defense claim, possibly in April, but need money in order to pay legal expenses.


?The State has virtually unlimited resources to prosecute George,? the site reads. ?To finance his defense, however, George relies on the generosity of individuals who believe he is innocent.?

?As we prepare for an (sic) Self-Defense Immunity Hearing or a trial, the cold fact is that we must raise more money,? the website reads. ?Our goal is to raise $30,000 per month. This represents the minimum we calculate we need to conduct the defense George deserves, and this figure does not include any attorney's fees.?

The lawyers say on the website that as of a month ago more than $300,000 has been raised to pay for Zimmerman?s defense, but also say that when O?Mara first took the case last year, many legal analysts predicted the defense would cost more than $1 million. ?The attorneys say neither O?Mara nor his co-counsel Mark West has been paid for their services.

This is how the, $314,099.07 raised by the defense fund has been spent, according to the site:

  • Security - $56,100.00
  • Law firm support and infrastructure - $40,647.64
  • Case-related expenses - $35,588.07

The site solicits donations via PayPal, credit card or check. The O?Mara Law Group in Orlando is the site?s registered owner. Zimmerman set up a website of his own to solicit money on April 8, 2012, but stopped taking donations when O?Mara launched gzdefensefund.com on April 23, 2012.

The Zimmerman case ignited an emotional debate over race and gun rights in the weeks after Martin's death. Local police initially did not charge Zimmerman, fueling protests, and Zimmerman was later charged by special state prosecutor Angela Corey following an investigation.

Zimmerman, who is of white and Hispanic descent, has pleaded not guilty to the murder charge. He says he shot Martin in self-defense after Martin attacked him. He is free on bail.

?It?s not unusual in high-profile cases for there to be a defense fund,? Derek Byrd, president of the?Florida Association of Criminal Defense Lawyers?told NBC News. ?In the the old days people would go knocking on neighbors? doors or ask friends. Today, with social media ? Twitter, Facebook, websites ? you can see where people would use them to reach a bigger audience.?

Byrd agreed with O?Mara that prosecutors can tap more resources for their case. He said defense attorneys have large expenses to hire experts, transcribe depositions and other related expenses.

E-mails sent to O'Mara's law firm were not returned, and repeated attempts to call his office phone met with a busy signal. E-mails and phone messages sent to prosecutor Corey were also unanswered.

First artificial enzyme created by evolution in a test tube

Jan. 30, 2013 ? There's a wobbly new biochemical structure in Burckhard Seelig's lab at the University of Minnesota that may resemble what enzymes looked like billions of years ago, when life on earth began to evolve -- long before they became ingredients for new and improved products, from detergents to foods and fuels.

Seelig created the fledgling enzyme by using directed evolution in the laboratory. Working with colleague Gianluigi Veglia, graduate student Fa-An Chao, and other team members, he subsequently determined its structure, which made its debut December 9 as an advance online publication in Nature Chemical Biology. Lab tests show that the enzyme (a type of RNA ligase, which connects two RNA molecules) functions like natural enzymes although its structure looks very different and it is flexible rather than rigid. Seelig speculates the new protein resembles primordial enzymes, before their current structures evolved.

Seelig and Veglia are professors in the College of Biological Sciences, where Fa-An Chao is a graduate student. Both faculty members have appointments in the Department of Biochemistry, Molecular Biology and Biophysics and Seelig is member of the BioTechnology Institute. Veglia also has an appointment in the Department of Chemistry in the university's College of Science and Engineering.

While a handful of groups worldwide are developing artificial enzymes, they use rational design to construct the proteins on computers. Instead, the Seelig lab employs directed evolution. "To my knowledge, our enzyme is the only entirely artificial enzyme created in a test tube by simply following the principles of natural selection and evolution," he says.

Rational enzyme design relies on preconceived notions of what a new enzyme should look like and how it should function. In contrast, directed evolution involves producing a large quantity of candidate proteins and screening several generations to produce one with the desired function. With this approach, the outcome isn't limited by current knowledge of enzyme structure.

"Just as in nature, only the fittest survive after each successive generation," Seelig explains. The process continues until it produces an enzyme that efficiently catalyzes a desired biochemical reaction. In this case, the new enzyme joins two pieces of RNA together.

"It's kind of like giving typewriters to monkeys," he says. "One monkey and one typewriter won't produce anything clever. But if you have enough monkeys and typewriters, eventually one of them will write 'to be or not to be'." The lottery provides another analogy. "If you buy more tickets, you're more likely to win," Seelig says.

Like all proteins, the new RNA ligase enzyme is a chain of amino acids folded into a 3D structure, but the resemblance stops there. Natural enzymes, like all proteins, are made from alpha helices and beta strands. Seelig's artificial enzyme lacks those structures. Instead, it forms around two metal ions and is not rigid. "Compared to enzymes we know from nature, the artificial enzyme has a rather unusual structure and dynamics," Seelig says.

For decades, naturally occurring enzymes have been tweaked by industry to make industrial processes and products more effective. The ability to create enzymes from scratch using a natural process opens the door to a vast array of new products that provide business opportunities and improve quality of life without harmful environmental effects.

Going forward, Seelig plans to create enzymes with useful applications while he continues to explore the underlying basic science of enzyme structure and function, aiming to learn more about the origin of enzymes and how proteins evolve.

"Enzymes have always fascinated me," he says. "It's rewarding to do work that has practical applications yet provides the opportunity to better understand how life on earth evolved."

Actor Jim Nabors marries male partner in Seattle

HONOLULU (AP) ? Jim Nabors, the actor best known for playing Gomer Pyle on TV in the 1960s, has married his longtime male partner.

Hawaii News Now (http://bit.ly/14tFM3U ) reports Nabors, 82, and Stan Cadwallader, 64, traveled from their Honolulu home to Seattle to be married Jan. 15. Gay marriage became legal in Washington state last month.

The couple met in 1975 when Cadwallader was a Honolulu firefighter.

"I'm 82 and he's in his 60s and so we've been together for 38 years and I'm not ashamed of people knowing, it's just that it was such a personal thing, I didn't tell anybody," Nabors said. "I'm very happy that I've had a partner of 38 years and I feel very blessed. And, what can I tell you, I'm just very happy."

Nabors said he's been open about his homosexuality to co-workers and friends but never acknowledged it to the media before. He doesn't plan to get involved in the issue politically.

"I'm not a debater. And everybody has their own opinion about this and actually I'm not an activist, so I've never gotten involved in any of this," Nabors told Hawaii News Now.

Nabors became an instant success when he joined "The Andy Griffith Show" in spring 1963. The character of Gomer Pyle ? the unworldly, lovable gas pumper who would exclaim "Gollllll-ly!" ? proved so popular that in 1964 CBS starred him in "Gomer Pyle, U.S.M.C."

In the spinoff, which lasted five seasons, Gomer left his hometown of Mayberry to become a Marine recruit. His innocence confounded his sergeant, the irascible Frank Sutton.

Analysis: Dell LBO talks reveal other leverage options

NEW YORK (Reuters) - A bid to take Dell Inc private by buyout firm Silver Lake and its partners underscores the financing market's willingness to lend up to $15 billion to the world's No.3 PC maker -- money that could be used to buy back shares and pay dividends even if the deal doesn't come together.

The Silver Lake-led bidding group has lined up debt financing from at least four major banks and is negotiating a final price to pay Dell shareholders, people familiar with the matter have said.

Should the buyout talks collapse, Dell could still choose to borrow itself and embark on a large share repurchase, in what investors and analysts refer to as a "Plan B".

"Whatever they are going to do, they could do in a public setting," said a senior executive at a competing private equity firm that is not currently involved in the deal.

"Shareholders could demand that Dell borrows the same money Silver Lake was going to borrow, buy back shares from whomever wants to sell them, and whoever stays involved can go about restructuring the business. That's a possible outcome here," the executive said on condition of anonymity.

This "Plan B" could also be deployed in the event that Dell shareholders reject any buyout deal reached between Silver Lake and Dell, shareholders and analysts said. This could be one viable alternative to a sale, and could increase Dell's negotiating power as it tries to agree on a final price with Silver Lake, they added.

"There are a handful of (companies) where founders tried to take the name private and ended up executing a leveraging strategy as a public company," Barclays analyst Hale Holden wrote in a January report.

In the mid-2000s, the Dolan family, which holds a controlling stake in Cablevision Systems Corp, ditched plans to take the cable operator private and levered up the company instead. The family returned two years later with yet another bid, only to be thwarted by Cablevision's other top shareholders that deemed the family's offer as too low.

More recently, most of the failed private equity deals over $10 billion resulted in major share repurchases. Companies including Fidelity National Information Services, BMC Software Inc and Seagate Technology Plc all opted to return large amounts of capital to investors after exploring a potential sale to private equity.

BEST DEAL FOR SHAREHOLDERS

To be sure, a "Plan B" may not necessarily deliver as much value for shareholders as Silver Lake's bid. It could also be viewed by critics as financial engineering that does not offer Dell the new strategy it needs.

Silver Lake, partnered with Microsoft Corp and Canada Pension Plan Investment Board in its bid, and offered $13 to $14.25 per Dell share, sources said. The deal's size would range between $22 billion and $24 billion based on the number of outstanding shares.

As a public company, Dell is unlikely to borrow as much as Silver Lake and its partners would. In the absence of a buyout, Dell would also not be getting any new equity investment from Silver Lake's consortium.

But in the case of Dell, whose PC business has been struggling to adapt to the popularity of gadgets such as tablets, a leveraged recapitalization could be viewed by critics as a mere financial engineering that does not offer the Round Rock, Texas-based company the new strategy it needs.

Under that scenario, Dell would also have to undertake reforms in a public setting. It could use the PC business for cash generation and focus on high-value services for corporate clients, investors and analysts said.

"We assume Dell's strategy in going private is to complete a major transformation away from the scrutiny of public shareholders. Therefore, a leveraged recap would not address this issue," said Shannon Cross of Cross Research.

Dell has formed a special committee of its independent directors and hired Evercore Partners Inc to assess whether the company is getting the best deal for shareholders and not one that is just in the best interest of Chief Executive Michael Dell, who would back a Silver Lake bid, people familiar with the matter have previously told Reuters.

Michael Dell, who holds roughly 16 percent of the company, will need to gain the support of other large shareholders, such as Southeastern Asset Management, the company's second largest shareholder with a 7.49 percent stake, to ensure Silver Lake's bid succeeds.

With Silver Lake having won Michael Dell's blessing, other private equity firms are unlikely to try to thwart the current bidding group, people familiar with the matter told Reuters last week.

KABUL (AP) ? The top commander of U.S.-led forces in Afghanistan believes government security forces have improved faster than expected and will be ready to take the lead in the 11-year-old war against the Taliban when foreign combat forces take a back seat this spring.

Marine Gen. John Allen told The Associated Press that the main job over the next two years for the International Assistance Force ? as the NATO-led troops in Afghanistan are called ? will be to advise, train and build the capabilities needed for Afghan forces to go it completely alone.

They will face their first test when the fighting season gets under way in the late spring and summer. During the harsh Afghan winter, snow often blocks roads and fighting dies down.

The Afghan security forces, which have nearly reached their full strength of 352,000, still need much work to become an effective and self-sufficient fighting machine, but a vast improvement in their abilities was behind a decision to accelerate the timetable for putting them in the lead nationwide, Allen said.

President Barack Obama announced earlier this month that the Afghans would take over this spring instead of late summer ? a decision that could allow the speedier withdrawal of foreign forces from Afghanistan.

The Afghan troops "are further along in their capabilities than we had anticipated, and I'm very comfortable frankly with their being in the lead in 2013," Allen said in a recent interview ahead of his departure. "This is an acknowledgment of their capabilities."

The general, who has led the military coalition for 19 months, is leaving Afghanistan on Feb. 10. The White House said it would nominate him to become the head of NATO forces in Europe after he was exonerated in a Pentagon investigation of questionable email exchanges with a Florida woman linked to the sex scandal that led his predecessor, David Petraeus, to resign as CIA director.

Allen, 59, of Warrenton, Virginia, said the investigation was troublesome, but he was confident that the process would clear him.

"I'll make no secret that it was on my mind, but my number one goals were the interests of the troops, the coherence of the campaign and doing all I could obviously to further our combined interests here," he said. "But it does weigh on you, and while it weighed on me it really weighed on my family, it really weighed on my family, and the findings ultimately were announced and I continue to move on."

If confirmed by the Senate, Allen would succeed Navy Adm. James Stavridis in the NATO post.

He would not comment on how quickly the remaining 66,000 U.S. troops would return home, or how many American soldiers will remain after the end of 2014, when all foreign combat troops are to leave Afghanistan ? saying Obama will make that decision.

"We are advising now, and for the foreseeable future and until the latter part of the spring we will be advising at the battalion level," Allen said, adding that the advising would progressively move up to larger formations until the work was completed. "This is in conjunction with the drawdown of our own forces and in a very measured way, in a way that the Afghans are familiar with and we are able to predict we will eventually move up to the corps level."

Afghan troops already have taken the lead for security on territory holding 85 percent of the country's population of around 30 million.

"In many respects they are already leading operations, 80 percent of operations across the country are being led by the Afghans right now. So I am confident that in this coming fighting season, where technically they will be in the lead across the country operationally, that they are ready and we will be in support of them," Allen said. "I think they are going to do fine this year and we will stay with them. There is much work still to be done."

The Afghan lead in fighting has already become apparent in the casualty figures.

U.S. troop deaths declined overall from 404 in 2011 to 295 in 2012. More than 2,000 U.S. troops and nearly 1,100 coalition troops have died here since the U.S. invasion in late 2001. Last year many of those deaths were at the hands of the Afghan forces they were partnered with or training. Deaths from so-called insider attacks ? Afghan police and troops killing foreign allies ? surged to 61 in 45 attacks last year compared with 2011, when 35 coalition troops were killed in 21 attacks

By comparison, more than 1,200 Afghan soldiers died in 2012 compared to more than 550 in 2011, according to data compiled by the Washington-based Brookings Institution.

Many are concerned that the Afghan forces will not be up to the task of securing the country after 2014. The size of the force will also have to be reduced after coalition forces leave because much of the funding for it will have dried up. At its summit in Chicago last May, NATO agreed on a fundraising goal to underwrite a force of about 230,000 that would cost about $4.1 billion annually.

When Allen took over from Petraeus in July 2011, the war was in full force. But the tide was turning, and public opinion in the United States and in coalition countries was tiring of a lengthy conflict that was widely seen as propping up a corrupt and thankless Afghan government.

In mid-2010, the United States had more than 100,000 troops and coalition forces totaled close to 150,000. The U.S. was spending billions of dollars on a costly counterinsurgency strategy that had all the hallmarks of nation-building. The Afghan army and police were rapidly growing thanks to a mostly U.S.-funded program that cost more than $20 billion, but their combat abilities did not match their numbers.

"When I got here we had virtually no battalion level operations under way, and the brigade level operation was only an ambition. Today, every day, there are brigade and corps level operations going on across Afghanistan," Allen said. He said those operations were being planned, carried out and often supplied by the Afghans, with foreign troops there in a mostly advisory role.

The improvements allowed Obama and Afghan President Hamid Karzai to announce the spring handover date earlier this month.

Allen said the decision was made after the withdrawal last September of the 33,000 U.S. troops who were part of a surge announced by Obama in December 2009. In early 2012, Allen said he was grappling with the question of how many combat brigades he could carve out of the 68,000 troops that would remain in Afghanistan after the withdrawal, but the drawdown actually provided an opportunity to thrust Afghan forces in the lead.

"The term that I used was they were better than we thought, more importantly they were better than they thought," he said.

But the Afghan forces still need work and to build up key capabilities, including their ability to sustain themselves on the battlefield ? from medical evacuations to fuel and ammunition ? and to carry out combined arms operations.

"The building of their capabilities will take time," Allen said, adding that he was "comfortable that our plan to do both these things is on track over time."

The Afghan military will have to make do without requested weapons such as heavy tanks and F-16 fighter jets, but Allen said the equipment that they will receive should give them considerable firepower. They include converting MI-17 transport helicopters to gunships and providing Afghan combat units at all levels with mortars.

He said the Afghans had to get used to the idea that they will not have the same air support in the future as they have today. Currently the coalition can provide air support to troops on the ground anywhere in Afghanistan within 12 minutes of a request.

"They have to get used to their own resources being the firepower necessary," he said.

In-brain monitoring shows memory network

Jan. 29, 2013 ? Working with patients with electrodes implanted in their brains, researchers at the University of California, Davis, and The University of Texas Health Science Center at Houston (UTHealth) have shown for the first time that areas of the brain work together at the same time to recall memories. The unique approach promises new insights into how we remember details of time and place.

"Previous work has focused on one region of the brain at a time," said Arne Ekstrom, assistant professor at the UC Davis Center for Neuroscience. "Our results show that memory recall involves simultaneous activity across brain regions." Ekstrom is senior author of a paper describing the work published Jan. 27 in the journal Nature Neuroscience.

Ekstrom and UC Davis graduate student Andrew Watrous worked with patients being treated for a severe seizure condition by neurosurgeon Dr. Nitin Tandon and his UTHealth colleagues.

To pinpoint the origin of the seizures in these patients, Tandon and his team place electrodes on the patient's brain inside the skull. The electrodes remain in place for one to two weeks for monitoring.

Six such patients volunteered for Ekstrom and Watrous' study while the electrodes were in place. Using a laptop computer, the patients learned to navigate a route through a virtual streetscape, picking up passengers and taking them to specific places. Later, they were asked to recall the routes from memory.

Correct memory recall was associated with increased activity across multiple connected brain regions at the same time, Ekstrom said, rather than activity in one region followed by another.

However, the analysis did show that the medial temporal lobe is an important hub of the memory network, confirming earlier studies, he said.

Intriguingly, memories of time and of place were associated with different frequencies of brain activity across the network. For example, recalling, "What shop is next to the donut shop?" set off a different frequency of activity from recalling "Where was I at 11 a.m.?"

Using different frequencies could explain how the brain codes and recalls elements of past events such as time and location at the same time, Ekstrom said.

"Just as cell phones and wireless devices work at different radio frequencies for different information, the brain resonates at different frequencies for spatial and temporal information," he said.

The researchers hope to explore further how the brain codes information in future work.

The neuroscientists analyzed their results with graph theory, a new technique that is being used for studying networks, ranging from social media connections to airline schedules.

"Previously, we didn't have enough data from different brain regions to use graph theory. This combination of multiple readings during memory retrieval and graph theory is unique," Ekstrom said.

Placing electrodes inside the skull provides clearer resolution of electrical signals than external electrodes, making the data invaluable for the study of cognitive functions, Tandon said. "This work has yielded important insights into the normal mechanisms underpinning recall, and provides us with a framework for the study of memory dysfunction in the future."

Additional authors of the study are Chris Connor and Thomas Pieters at the UTHealth Medical School. The work was supported by the Sloan Foundation, the Hellman Foundation and the NIH.

Thick, off-the-scale smog shrouded eastern China for the second time in about two weeks Tuesday, forcing airlines to cancel flights because of poor visibility and prompting Beijing to temporarily shut factories and curtail fleets of government cars.

The capital was a colorless scene. Street lamps and the outlines of buildings receded into a white haze as pedestrians donned face masks to guard against the caustic air. The flight cancellations stranded passengers during the first week of the country's peak, six-week period for travel surrounding the Chinese New Year on Feb. 10.

The U.S. Embassy reported an hourly peak level of PM2.5 ? tiny particulate matter that can penetrate deep into the lungs ? at 526 micrograms per cubic meter, or "beyond index," and more than 20 times higher than World Health Organization safety levels over a 24-hour period.

Liu Peng, an employee at a financial institution in Beijing, said he will keep his newborn baby indoors.

"It's really bad for your health, obviously," Liu said. "I bike to work every day and always wear a mask. The pollution in recent years is probably due to the increase in private cars and government cars."

Visibility was less than 100 meters (100 yards) in some areas of eastern China, the official Xinhua News Agency reported. More than 100 flights were canceled in the eastern city of Zhengzhou, 33 in Beijing, 20 in Qingdao and 13 in Jinan.

Every year, China's transport system bursts at the seams as tens of millions of people travel for the Lunar New Year holiday, in the world's largest seasonal migration of people.

Ren Haiqiang, a bank worker in his early 30s, said he had booked tickets to fly out of Beijing on Thursday to visit family in the coastal city of Dalian, but now worried about flight cancellations.

"Traveling over the holiday is already a huge hassle, along with all the gift-giving and family visits. We thought flying would be the best way to avoid the crush, but if the weather continues like this we'll be in real trouble," Ren said as he waited in line at a bakery in downtown Beijing.

Beijing's city government ordered 103 heavily polluting factories to suspend production and told government departments and state-owned enterprises to reduce their use of cars by a third, Xinhua said. The measures last until Thursday.

Beijing's official readings for PM2.5 were lower than the embassy's ? 433 micrograms per cubic meter at one point in the afternoon? but even that level is considered "severe" and prompted the city government to advise residents to stay indoors as much as possible. The government said that because there was no wind, the smog probably would not dissipate quickly.

Patients seeking treatment for respiratory ailments rose by about 30 percent over the past month at the Jiangong Hospital in downtown Beijing, Emergency Department chief Cui Qifeng said.

"People tend to catch colds or suffer from lung infections during the days with heavily polluted air," he said.

Air pollution has long been a problem in Beijing, but the country has been more open about releasing statistics on PM2.5 ? considered a more accurate reflection of air quality than other pollutants ? only since early last year. The city hit its highest readings on Jan. 12, when U.S. Embassy readings of PM2.5 reached as high as 886 micrograms per cubic meter.

Celebrity real estate developer Pan Shiyi, who has previously pushed for cities to publish more detailed air quality data and who is a delegate to Beijing's legislature, called Tuesday morning for a "Clean Air Act." By late afternoon, his online poll had received more than 29,000 votes, with 99 percent in favor.

On Monday, Wang Anshun was elected Beijing's mayor after telling lawmakers the municipal government should make more efforts to fight air pollution, according to Xinhua.

Last week, he announced plans to remove 180,000 older vehicles from the city's roads and promote government cars and heating systems that use clean energy.

Google pledges fight over access to users' email

Google will lobby?Washington this?year?to make it harder for law enforcement authorities to gain access to emails and other digital messages.

In a blog post on Monday, linked to Data Privacy Day, Google's chief legal officer, David Drummond, said the tech giant, in coalition with many other powerful tech companies, will try to convince Congress to update a 1986 privacy protection law.

He cited data, shared last week, showing that government requests for Google's user data increased more than 70 percent since 2009.

In 2012, Google said, it received 16,407 requests for user data affecting 31,072 users or accounts, more than half of them accompanied by a subpoena.

"We're a law-abiding company, and we don't want our services to be used in harmful ways. But it's just as important that laws protect you against overly broad requests for your personal information," Drummond said in the post.

The U.S. Electronic Communications Privacy Act, passed in the early days of the Internet, does not require government investigators to have a search warrant when requesting access to old emails and messages that are stored online, providing less protection for them than, say, letters stored in a desk drawer or even messages saved on a computer's hard drive.

The current system also makes complex distinctions, many disputed in courts, between emails saved as drafts online, in transit, unopened or opened. Some of them are to be released with subpoenas, which have a lower threshold than search warrants as they often do not involve a judge.

A warrant is generally approved by a judge if investigators have "probable cause" to believe that their search is likely to turn up information related to a crime.

Google, Microsoft, Yahoo and popular social media site Twitter ? among others ? have resisted turning over customer data.

They have put in place policies, based on the constitutional protection from unreasonable searches, that require search warrants for access to content of private communications.

Privacy activists say the outdated law should be reformed to extend the constitutional right to privacy online, but legislation limiting government requests will not face an easy road.

Last year, Democratic Senator Patrick Leahy, who chairs the Senate Judiciary Committee, introduced a bill that would have updated the current law.

It triggered a wave of concerns from the police and FBI that new restrictions would impede crime investigations and possibly endanger victims.

"After three decades, it is essential that Congress update ECPA to ensure that this critical law keeps pace with new technologies and the way Americans use and store email today," Leahy said in a statement on Monday.

His privacy legislation died in Congress last year after his counterpart in the House of Representatives, House Judiciary Committee Chairman Bob Goodlatte, a Republican, drafted another version of that bill, which also tackled other issues but stripped out privacy reform language.

Last year, Goodlatte said he was willing to consider the privacy law reform, but that the timeline then was too short for a "thorough examination."

Leahy has now included the change of privacy laws as one of his top priorities this year.

Exclusive: Boy Scouts close to ending ban on gays

NBC's Pete Williams reports on the major policy shift being considered by the Boy Scouts of America.

The Boy Scouts of America, one of the nation?s largest private youth organizations, is actively considering an end to its decades-long policy of banning gay scouts or scout leaders, according to scouting officials and outsiders familiar with internal discussions.

If adopted by the organization?s board of directors, it would represent a profound change on an issue that has been highly controversial -- one that even went to the US Supreme Court. The new policy, now under discussion, would eliminate the ban from the national organization?s rules, leaving local sponsoring organizations free to decide for themselves whether to admit gay scouts.

?The chartered organizations that oversee and deliver scouting would accept membership and select leaders consistent with their organization?s mission, principles or religious beliefs,? according to Deron Smith, a spokesman for the Boy Scouts? national organization.

Individual sponsors and parents ?would be able to choose a local unit which best meets the needs of their families,? Smith said.

The discussion of a potential change in policy is nearing its final stages, according to outside scouting supporters. If approved, the change could be announced as early as next week, after the BSA's national board holds a regularly scheduled meeting.

Only seven months ago, the Boy Scouts affirmed a policy of banning gay members, after a nearly two-year examination of the issue by a committee of volunteers convened by national leaders of the Boy Scouts of America, known as the BSA.

In a statement last July affirming the ban, its national executive board called it ?the best policy for the organization.?

But since then, a scouting official said, local chapters have been urging a reconsideration. "We're a grassroots organization. This is a response to what's happening at the local level," the official said.

Two corporate CEOs on BSA?s national board, Randall Stephenson of AT&T and James Turley of Ernst & Young, have also said they would work to end the ban. Stephenson is next in line to be the BSA?s national chairman. During the 2012 presidential campaign, both Barack Obama and Mitt Romney said the BSA should admit gay scouts and scout leaders.

About 50 local United Way groups and several corporations and charities have concluded that the ban violates their non-discrimination requirements and have ceased providing financial aid to the Boy Scouts. An official of The Human Rights Campaign, an advocate for gay rights, said HRC planned to downgrade its non-discrimination ratings for corporations that continue to give the BSA financial support.

?It?s an extremely complex issue,? said one Boy Scouts of America official, who explained that other organizations have threatened to withdraw their financial support if the BSA drops the ban.

While the national scouting organization sets broad policies, more than 290 local councils nationwide govern the day-to-day conduct of the more than 116,000 local organizations. Individual scouting troops are sponsored by religious and civic organizations that represent a diversity of views on the issue of allowing gay scouts and leaders.

?The beliefs of the sponsoring organizations are highly diverse,? the official said.

The policy change now under discussion ?would allow the religious, civic or educational organizations that oversee and deliver Scouting to determine how to address this issue,? said the BSA's Smith.

?The Boy Scouts would not, under any circumstances, dictate a position to units, members or parents. Under this proposed policy, the BSA would not require any chartered organization to act in ways inconsistent with that organization?s mission, principles or religious beliefs,? he said.

In 2000, the U.S. Supreme Court concluded that the Boy Scouts had a First Amendment right of free expression when it came to the organization?s belief that homosexual conduct is inconsistent with values stated in the scout oath, requiring scouts to be ?morally straight.?

The Scouts have won similar legal battles, with courts finding that the BSA?s right of free association permits it, as a private organization, to reject those it believes do not conform to is values.?

A new study in the United Kingdom has some good news for children who suffer from asthma. According to researchers at the Imperial College London, childhood asthma attacks have dropped significantly since a law was enacted in 2007 banning smoking in enclosed spaces.

The new study, which was published in a recent issue of Pediatrics, found that the hospital admissions for children suffering from asthma attacks dropped more than 12 percent in the first year after the law was introduced in July 2007. ?The admission rates continued to decline in subsequent years suggesting that the health benefits from the law have had a sustained effect on England's kids.

?

Before the ban was implemented, hospital admissions for childhood asthma attacks were rising at a rate of 2.2 percent per year, with admissions hitting a peak of 26,969 admissions in 2006-07. ?Researchers estimate that the rapid decline in admissions, which began immediately after the law came into effect, is equivalent to 6,800 fewer hospital admission within the first three years after the law came into effect. ?

The decline in hospital admissions was seen across the board in both boys and girls and for children living in poor neighborhoods or wealthier communities.?

After being unveiled at the close of 2012, yesterday Samsung announced the Galaxy Grand for its native South Korea. At a glance the domestic build of this handset looks nearly identical to its foreign counterpart, however the device's spec sheet tells a different story. Riot police break up Greek subway workers' sit-in

ATHENS - Greek riot police stormed a subway train depot in Athens early on Friday to disperse striking subway staff who defied a government order to return to work for a ninth consecutive day, a police official said.

Scuffles broke out when police forced their way through a metal gate shortly after 4 a.m. (0200 GMT) and detained at least 10 workers, the official said on condition of anonymity. One woman was taken to hospital with light injuries, he added.

The escalating standoff has turned into the latest test for Greece's fragile coalition as it faces down the unions to implement austerity measures demanded by foreign lenders as the price for bailout funds.


Subway workers have ignored the order, issued under emergency legislation by the conservative-led government on Thursday, paralyzing the Athens subway in a week-long walkout.

About 90 workers stayed at the train depot overnight in protest. The subway workers, who have defied a court order to return to work, oppose being included in a unified wage scheme for public sector workers that would slash their salaries.

Bus and railway workers are joining the walkout on Friday in solidarity.

Under the emergency law, workers can face arrest and up to five years in jail. No arrests have been made so far, the official said.?

Merkel says Europe should not ease off on reforms now

DAVOS, Switzerland (Reuters) - German Chancellor Angela Merkel warned on Thursday against easing off on painful reforms in Europe, saying the bloc must ensure it took full advantage of its debt crisis to modernise and boost its competitiveness.

"The political experience is that often you need pressure for political structural reforms," Merkel said during a keynote speech at the World Economic Forum in Davos.

"My conclusion is therefore that if Europe is in a difficult situation today, we must implement the structural reforms today so we can live better tomorrow."

??? I am an interactive teacher who loves creative interaction. For me, a classroom holds opportunity and promise...but also a great challenge. The room is a first impression that can either intimidate or welcome..it can inspire or stifle. Preparations for a lesson always include making the room work for me; getting the right setting for engaging every aspect of a child and sparking their interests.
??? First consideration: what's available? Tables and chairs? Open floor space? Shelves or a sink? Some classrooms are equip with toys or books. Along with the available elements, layout is important. If I share a space with another ministry then I need to be mindful about the set up. Knowing the elements that already exist and how they are arranged help me set my mind to the next order of business.
?? My next consideration: What do I have at home? Basic art/craft supplies, paper goods, and some toys can easily be toted back and forth. Cookie sheets and magnets, rice in a tub, simple every day items can be creative avenues for little hands. It is amazing what house hold goods have traveled with me to aid in the lessons of the day.
?? Another question on the list: Do I have help? This helps me determine how far apart to set creative stations, not to mention some activities are just easier with a few more hands.

It warms my heart when a little one enters the classroom asking 'what's in the box today'.. they know me..and know we are going to learn, grow, and engage our hearts. There in I know I have made the room work for me.
